BLOTTER: Police reports published Feb. 1

Lockport Union-Sun & Journal — City of Lockport

DWI: Charles A. Restivo III, 41, 5706 Otto Park Place was charged with driving while intoxicated, leaving the scene of an auto accident, resisting arrest, obstructing governmental administration and failure to keep right Wednesday. The police responded to Niagara Street at 7:30 p.m. for the report of an accident. One of the vehicles was attempting to leave the scene. According to the report, police saw a man and woman walk towards a rear yard. Restivo fled on foot upon seeing patrol and jumped over several fences. He was taken into custody on Park Avenue. Restivo had a strong odor of alcoholic beverage and glassy eyes. He failed field sobriety tests. He was unable to be photographed due to his high level of intoxication.

MENACING: Joseph M. Andrews, 36, 101 Spalding St. upper was charged with second-degree menacing, unlawful possession of marijuana and criminal possession of a weapon Wednesday. The police responded to a report of a man wielding a baseball bat  on Washburn Street. According to the report, Andrews was engaged in an argument at a convenience store and returned armed with a bat and threatened some men. During the booking process, Andrews was found to be in possession of marijuana.

TRESPASS:  The sheriffs’ patrol was called to Wal-Mart for a trespasser complaint. According to the report, a person who was banned from all Wal-Marts, entered the store. The suspect took an empty shopping cart and a vacuum cleaner and tried to return it at the customer service counter. The suspect was identified.

PETIT LARCENY: Patrol was dispatched to Tim Horton’s Donuts at South Transit Road for a report of a larceny. According to the report, an employee had stolen money. The video camera showed the employee place a bill under the drawer and then remove four $20 bills and four $5 bills. Tim Horton’s wished to pursue charges and a statement was secured. Patrol completed the paperwork and submitted it to Town of Lockport Court for a warrant.
