LARCENY: Donald E. Diegelman, 76, 422 Chestnut Drive, Lockport was charged with petit larceny at 9:05 a.m. Monday after patrol responded to Tops, 5827 S. Transit Road, on a report of a shoplifter in custody. Upon arrival, a complainant said Diegelman attempted to leave the store with a shopping cart containing 2 packages of toilet paper, 2 pairs of cotton shorts, a bunch of bananas, shampoo, and Vaseline, without paying for the items. Diegelman was issued an appearance ticket.

LARCENY: An Ewings Road couple reported Monday that sometime between 2 p.m. Sunday and 7 p.m. Monday someone took items from their unlocked vehicles, which were parked in their driveway. Items taken included a Nextar GPS valued at $100, a black Apple iPod valued at $75 and an airblown inflatable lawn ornament off the front lawn, valued at $157.

DWI: Joshua M. Tram, 38, of Gilroy, Calif. was charged with DWI and refusing to take a breath test at 2:50 a.m. Tuesday. Deputies arrived at an Enterprise Drive address where a complainant said he had followed a a vehicle form Bear Ridge Road to Enterprise Drive because of its erratic operation. Patrol spoke with the driver, Tram, who said that he and his co workers had traveled to Canada to have dinner. While interviewing Tram, patrol could smell a strong odor of an alcoholic beverage emanating from him, and Tram admitted to drinking three beers at dinner. Patrol noticed signs of intoxication. Tram failed field sobriety tests. According to the report, patrol attempted to have Tram perform a breath screening at the scene but he refused to provide an adequate breath sample. Tram was remanded to the Niagara County Jail in lieu of $250 bail.

TRESPASSING: Todd M. DeLavalle, 23, 6491 Dysinger Road, Apt. 5, was charged with trespassing on Tuesday after he allegedly entered a neighboring apartment after being advised by sheriff’s deputies that he was not welcome in the apartment. He was issued an appearance ticket.

Newfane

DWI: Michael Henning, 33, 174 Washington St., Lockport, was charged with DWI, failure to keep right and speeding at 1:24 a.m. Tuesday after he was stopped on Lockport-Olcott Road for vehicle and traffic infractions. According to the report, patrol approached the vehicle and immediately smelled a strong odor of an alcoholic beverage omitting from Henning’s mouth and he admitted to consuming alcohol prior to operation of his motor vehicle. Henning displayed signs of intoxication and he failed field sobriety tests. Henning refused a chemical test to determine his blood alcohol content. He was held in lieu of $250 bail.

Wilson

ASSAULT: Sheriff’s patrol was sent to Wilson High School just before 4 p.m. Tuesday for a report of an assault that occurred there the day before. The legal guardians of a female victim told patrol that the victim was grabbed by the hair and had her head slammed into a concrete wall by another female. The incident was caught on school surveillance and was witnessed by several other students. According to the report, the assaialnt was suspended from school for five days and the vicitm was treated at St. Marys Hospital for a concussion and discharged. The guardians did not want to press charges, but wanted a report filed and the incident documented.
