Mongielo case adjourned

TOWN OF LOCKPORT — An auto repair shop owner facing another charge for his video sign will return to court March 20 in the Town of Lockport.

The case against David J. Mongielo was adjourned Tuesday, according to town prosecutor Bradley Marble. Mongielo is accused of violating Lockport’s sign ordinance, which says any sign capable of changing its format or message may not change any more than once every 10 minutes.

Mongielo has such a sign in front of his shop, Mongielo’s Auto Specialties on Robinson Road.

He was previously found guilty on three counts of violating the town sign law in September 2010. He was cited on three different occasions. He was fined $750, or $250 for each count.

He was accused in August of violating the ordinance again and last appeared in court in December.

Town Justice Raymond E. Schilling is scheduled to deliver his verdict at the court hearing and will sentence Mongielo if he is convicted of violating the ordinance.

Mongielo could be looking at jail time. With the fines came a one year conditional discharge that could carry a 15 day jail sentence if the ordinance was violated again.

Mongielo declined to comment Tuesday.
