Bail was denied Friday for a suspect who pleaded guilty in the Sept. 7 armed robbery of Kentucky Fried Chicken on West Avenue.
David L. Nelson, 26, 6 Gabriel Drive, Apt. B, will be back in Niagara County Court for a hearing Jan. 29.
Bail originally was set at $500,000, but was denied at Friday’s hearing by Judge Sara S. Sperrazza.
Nelson was charged with first-degree attempted robbery, a felony, and is expected to pay back the $212.50.
Nelson is one of four suspects police say were involved in the robbery. Nelson was represented by Joseph Catalano of the public defender’s office.
During the hearing, Nelson denied the allegations by Assistant District Attorney Peter M. Wydysh that a gun was shot, breaking a window.
Nelson apparently became confused when Sperrazza asked him if it was true that he forcibly stole a total of $212.50 from the restaurant and a victim at the scene.
At the time of the KFC robbery, Nelson still had three days left to serve on parole, Wydysh said.
“Because Nelson is a second-time offender, this ups his minimum imprisonment from 31⁄2 half years to five,” Wydysh said. He faces a maximum imprisonment of 15 years.
In 2005, Nelson was convicted in Niagara County Court of first-degree robbery, Sperrazza said.
